Use of Force and Arrest Related Death


Use of Force and Arrest Related Death (UFAD) form is used to report subjects who receive serious injuries or die while being arrested or while in custody. This information is required to be reported by law enforcement agencies as outlined by the linked content below.

The FBI fully launched their new national use-of-force data collection effort as part of the Uniform Crime Reporting (UCR) program in January 2019. The national program is focused on identifying incidents that result in death or serious bodily injury of a person, or when an officer discharges their firearm at or in the direction of a person. In order to comply with this new collection effort, the Wisconsin Department of Justice created a workgroup of Wisconsin law enforcement agencies, led by the BJIA, to develop a Wisconsin use-of-force data collection program that would fulfill federal requirements and make recommendations to collect other data valuable in understanding use-of-force incidents in Wisconsin. In addition, this workgroup was tasked with defining what will qualify as use-of-force in Wisconsin, determining the data elements and types of force that will be collected, and establishing a process for the reporting of the data.

The Wisconsin workgroup finalized recommendations regarding the Wisconsin approach to this data collection effort in early 2019. The BJIA then took these recommendations, in a partnership with the State Patrol and their Traffic and Criminal Software (TraCS) program, to develop a data reporting form that satisfied reporting requirements for the FBI’s Use-of-Force program. The Wisconsin program also addressed federal reporting requirements under the Death in Custody Reporting Act, which requires collection on arrest-related deaths, as well as deaths occurring in jails and prisons. The development of the TraCS form occurred throughout 2019 and will be rolled out statewide in the fourth quarter of 2019. The state will also develop an additional data collection mechanism, including a process for electronic database submission, for agencies unable to utilize the TraCS program or for agencies that would prefer to submit the data electronically from their existing Records Management System (RMS) or other systems for use-of-force data collection. The Wisconsin DOJ will then submit use-of-force data collected through the state program on behalf of law enforcement agencies to meet federal reporting expectations.

  • The data collected through this effort are critical to supporting law enforcement training needs in Wisconsin and to promote transparency in sharing this data with stakeholders, researchers, policy makers, the media and the community by providing a more complete picture of the nature and context of use-of-force incidents.

In the Fall of 2024 the UFAD form will be versioned up.

Noted fields/segments were requested to be added to the UFAD form by law enforcement agencies via the TraCS Forms Advisory Committee (TraCS FAC).  None of the below fields will be required on the UFAD form and none of the data indicated in them is collected by the DOJ.

These new fields have been added by law enforcement request to allow for agencies to better utilize the UFAD form as an in-house use-of-force tracking tool, for those agencies that utilize the form to track all use-of-force incidents within their agency, not just reportable incidents.

  • Electronic Control Device (ECD) Reporting Group

  • Location of Force Used Diagram

  • Was the Subject Suicidal?

  • Subject's Treatment (used to indicate if the subject accepted/declined/etc. medical treatment after the incident)

  • Empty Hand Techniques Used on Subject

  • Was Subject Arrested or Transported to Jail?

You can always check the "Field Help" in the upper-left of TraCS when highlighting a field in the UFAD form to check if it is optional. If it is, you will see this:

Remember, since any non-reportable UFAD incident you file is not sent to the state, in any month that your agency has no  reportable incidents, a zero report must be transmitted to the state instead

Document Group

The form contains one Document group as shown below.

By answering the first 5 questions, the form type will be determined and the corresponding fields for each report type will be enabled.

  • Are you documenting a Use of Force or Arrest Related Death incident?

    • If No - Reporting Month and Reporting Fields are enabled for entry. Report Type is set to No Report.

    • If Yes - the next field is enabled.

  • Did subjects(s) die while detained, arrested or during being arrested?

    • When set to Yes, opens the Date of Death, Time of Death and Death Narrative fields in the Subject Group.

  • Agency Report Type

    • This is a new Agency field was added in Fall 2024

    • The table used is shared with the incident form is Incident Report type

Summary Group

Each form contains one Summary Group.

3 fields will be updated with pending added as an option.

New Pending Options

Previously, some DOJ-required fields within the TraCS UFAD form did not have an explicit "Pending" option to utilize when a field was unable to be completed due to its information being unavailable due to a pending investigation. The proper way to handle this was to leave the field blank to indicate pending.

With the Fall TraCS Pack, many new explicit "Pending" options will be added to fields where they were not previously available, making it easier to indicate when information for a certain field is pending further investigation.

As a reminder, all fields with "Pending Further Investigation" are treated as placeholders, and are expected to be updated as soon as the surrounding investigation(s) conclude.

Also remember that forms with Pending values will not pass final validation, as a form cannot be finalized with temporary placeholder values such as "Pending".

Form Mechanic fields (fields that trigger other actions)

  • Was this part of a multi-agency unit or taskforce operation?

    • When checked Yes, the Number of Additional Agencies and Total Officer field are enabled for data entry.

  • Number of Additional Agencies

    • Value in this field is used to create the needed number of Additional Agencies group.

  • Total Reporting Agency Officers

    • Value in this field is used to create the needed number of Officer groups.

  • Total Subjects

    • Value in this field is used to create the needed number of Subject groups.

  • Map Incident Location

    • Controls whether the Location group is enabled.

  • Reason for Initial Subject/Officer Contact

    • When Response to unlawful or suspicious activity is selected, the Related Offenses field in the Subject group is enabled.

 

Officer Group

Each form may contain 1 to 99 officer groups. Officer groups are created based on the number entered in the Total Officers from YOUR agency field in the summary section.

    • Opens the On-Duty Assignment and Shift Length fields.

  • Ballistic Vest Worn

    • Opens the Was Ballistic Vest Effective? field.

  • Firearm Discharged

    • Opens Firearm Employed, Initial Firing Distance, Ending Firing Distance, Shots Fired and Lighting a Factor fields.

  • Was the Officer Injured during the incident (serious or minor)

    • Opens the Injuries and Injury Time Frame


ECD Subgroup

The group will be available after the 2024 Fall pack is installed. It will auto open when ECD is choses as force or lesser force applied. This is an optional group and at this time not transmitted to the DOJ.

Electronic Control Device (ECD) Reporting Group Coming in Fall 2024

TraCS will be adding an ECD segment to the UFAD form that will appear any time that the Force Type or Force Type Lesser fields in the Officer segment indicate "ECD/Taser".

NOTE: the ORI Number field is being added in the Fall of 2024, this is a request of the DOJ so it will be included with transmission.

The new ORI number field will appear in the "Other Involved Agencies" segment any time that an agency has a reportable incident where they indicate that there were other involved agencies that also had officers that utilized reportable force:
This new field will auto-populate an ORI for the agency selected under the "Agency Name" field, allowing for our database to identify which Other Involved Agency is being indicated even when potential naming updates/changes occur within TraCS.

There is no procedural change your agency needs to make to utilize this new field properly, as it should work automatically.
